Terms of
Service

By using
our Web Design and Hosting Services, you agree to comply with the following:
Illegality
in any form is prohibited, including but not limited to activities
such as unauthorized distribution or copying of copyrighted
software, violation of U.S. export restrictions, harassment, fraud,
trafficking in obscene material, drug dealing, and other illegal
activities.
Any and all
services provided by Moore Web Development may be used for lawful purposes only.
This means, that illegal material is strongly prohibited. Transmission, storage,
or presentation of any information, data or material in violation of any US
Federal, State and/or City law, is prohibited. Any data that violates
international laws is forbidden as well. All content that we judge threatening
or obscene, and/or material protected by trade secret and other statute can and
will be reviewed by us and we can delete any material
that fits into any of the above and below cases, with no prior warning.
We will be
the sole arbiters as to what constitutes a violation of this provision, provided
that all such determinations shall be made reasonably in good faith based on
applicable law, regulation and the accepted norms of the Internet community. You
will be notified in time, and you’ll have to remove (censor) the material that
we point out, immediately. If we have need to contact
you more than 2 times concerning a violation caused by you, your account will be
discontinued with no refund. We reserve the right
to refuse service, terminate accounts, and/or cancel orders at our discretion,
including, without limitation, if we believe that
a customers conduct violates applicable law or is harmful to the interests of Moore
Web Development Services.
Unacceptable Content:
Moore Web
Development Services forbids any material to be stored on our servers that ARE
listed below. This includes links or any material referring to the following:
● Adult and/or Obscene
content
● Discriminatory and/or Hate content
● Pirated software (illegal duplication, distribution of licensed software).
● Hacker’s material.
● Warez Sites (Cracks to licensed software for example).
● Illegal audio/video (illegal mp3, illegal recorded samples).
Network and Server
Security:
Violations of system or
network security are prohibited, and may result in criminal and civil liability.
Examples include, but are not limited to the following: Unauthorized access,
use, probe, or scan of a systems security or authentication measures, data or
traffic. Interference with service to any user, host or network including,
without limitation, mail bombing, flooding, deliberate attempts to overload a
system and broadcast attacks, forging of any TCP-IP packet header or any part of
the header information in an email or a newsgroup posting.
Spamming:
It is
contrary to Moore Web Development Services policy for customers to use our
servers to effect or participate in any of the following activities:
● Sending of unsolicited email messages, including, without limitation, commercial
advertising and informational announcements, is explicitly prohibited. A user
shall not use another site's mail server to relay mail without the express
permission of the site.
● To send unsolicited mass e-mailings, if such unsolicited e-mailings provoke
complaints from the recipients.
● To engage in any of the foregoing activities using the service of another
provider, but channeling such activities through a Moore Web Development
Services provided server, or using a Moore Web Development Services provided
server as a maildrop for responses.
● To falsify user information provided to us or to
other users of the service in connection with use of a Moore Web Development
Services service.
● We react quickly and seriously to violations, and we further reserve the right
to terminate the network services, with no refund, of any customer willfully
disregarding this policy.
Consequences of Violation:
When we become aware of an alleged violation of its Terms of
Service, we will initiate an investigation. During
the investigation we may restrict Customer's access
in order to prevent further possible unauthorized activity. Depending on the
severity of the violation, Moore Web Development Services may, at its sole
discretion, restrict, suspend, or terminate Customer's account and/or pursue
other civil remedies. If such violation is a criminal offense, we will notify the appropriate law enforcement department of
such violation.
Billing:
Unless otherwise
arranged, we will invoice on the first of the month
following the month of services rendered. All payments will be due 30 days from
date of invoice unless other arrangements are made. A late fee of 15% per month
will be assessed on overdue accounts. In the event of non-payment we reserve the right to suspend the customers Website, lock
all access to the servers and place a hold on the customers domain name until
the customers account is paid in full. We also reserve
the right to use all legal means to collect on outstanding accounts.
Accuracy
of Site Content and Information:
Moore
Web Development Services strives to ensure that all content of sites designed by
us are accurate and correct but we assume no responsibility for errors in any
information, prices, and/or descriptions in the content of the customers web
site. We will notify the customer when changes or
edits are made to their site and it will be the customers responsibility to
review and test the changes and edits for accuracy.
Outages and Disruption of Service:
Although not anticipated there are times when a site may be down
for reasons out of the control of Moore Web Development Services including but
not limited to natural disasters, damaged fiber optics, local provider outages,
etc. If the customer feels that the site was out of service for an unacceptable
period of time, the customer may request, in writing, a refund of part or all of
that months hosting fee. We will consider each
request and at our discretion refund all or part of your hosting fee or issue an
extension of your current hosting term.
Success
of Site:
Moore Web
Development Service makes no guarantee as to the success of your site and/or the
search engine position of your site. Many factors including but not limited to
pricing, demand, search engine position, etc. impact your sites success. Our
Search Engine Optimization and Submission Submission services are done with
state of the art software but your position depends greatly on the number of
other sites in the same category, time your site has been up, other sites
that link to your site and other factors beyond our control.
Changes to Terms of Service:
Changes to the above terms of service may be made at any time and
without prior notice. All customers of Moore Web Development Services will be
notified by email anytime changes are made and it will be the customers
responsibility to read and understand the revised terms of service. |
